General Terms and Conditions ©

The following policy defines the terms and conditions for individuals or legal entities (hereinafter: “participant” and/or “user), participating in an event organized by Grid Singularity GmbH, a limited liability company, registered at Schinkestrasse 20, 12047 Berlin, Germany (hereinafter “Grid Singularity”), including payment and cancellation policies.

 

    1. By registering for and/or attending the Event (as defined below), participants are bound by, and comply with, these Terms and Conditions (“the contract”). It is the individual’s responsibility to read and understand these Terms and Conditions.
    2. For the purposes of these Terms and Conditions, the “Event” means any forum, plenary session, summit, networking session (including social gatherings), discussion session, awards ceremony and/or presentation, the details of which are as confirmed in the event agenda or otherwise in the registration process between the participant and Grid Singularity.
    3. In order to attend an event, participants must pay the relevant registration fee in full – or have paid in full on their behalf – immediately upon confirmation or by the event date. Confirmation by Grid Singularity of registration for the event forms a binding contract. Participants receive an electronic ticket (“Ticket”) upon confirmed registration. Payment may be made by credit card only.
    4. The registration fee does not include any travel or accommodation costs. The registration fee relates solely to Event attendance.
    5. Grid Singularity may provide a discount from the prevailing standard published rates (as per the registration web-page). Only one discount type/code may be applied against published standard rates. Discounted tickets are only valid in combination and/or in conjunction with an authorized identification qualifying for discount. This must be presented when purchasing the ticket and shown on request to gain admission to the event venue.
    6. In the case of a change of the event location (event venue), tickets remain valid.
    7. In the case of a change of the event date, the ticket may be returned by a deadline determined by Grid Singularity. After the deadline has expired, any claims for reimbursement will expire.
    8. Participants wishing to cancel their registration must do so in writing via email; in order for the cancellation to be deemed valid it must be acknowledged by Grid Singularity. Applicable cancellation fees are outlined as follows:
      1. Up to 4 weeks before the event date, a 50% cancellation fee will be applicable
      2. Less than 4 weeks before the event date, the full fee will be applicable
      3. No show, the full fee will be applicable.
    9. Damaged registration items received at the Event (in form of paper tickets, badges or wristbands) or electronic tickets and other registration items received at the Event misplaced by the participant shall not, as a basic principle, be replaced or refunded.
    10.  The purchase of tickets for commercial resale is prohibited.
    11. Tickets can be transferred to colleagues. A request to transfer a participant’s confirmed registration to a colleague should be made by giving written notice via email to contact@eventhorizon2019.com. Grid Singularity reserves the right to deny a request for such a substitution, but it will not unreasonably do so.
    12. The views expressed by any speaker at the Event are representative of the speaker’s own opinions and cannot in any way be attributed to Grid Singularity. Grid Singularity disclaims any liability for views expressed by any speaker at the Event.
    13. Grid Singularity reserves the right to reject a ticket sale or refuse entry if it is deemed that the potential attendee would in some way be an inappropriate delegate, in which case a full refund will be given if a ticket has been purchased. In the event of inappropriate behaviour by any participant in the view of Grid Singularity or the Event venue operator, the participant may be refused entry or asked to leave and excluded from the Event without refund or compensation.
    14. The details of the Event shown in any material supplied by Grid Singularity to the participant are correct at the time of printing/publishing, but the participant shall be responsible for checking with Grid Singularity that no alterations have been made.
    15. Grid Singularity is not responsible for personal items that are lost or damaged during events.
    16. Each participant must make provision for their own insurance. There is no coverage either through the Event venue operator and/or Grid Singularity.
    17. Participants register by using the Grid Singularity event website, EventHorizon2019.com. The user guarantees that all of the data supplied during registration is accurate.
    18. Grid Singularity cannot determine with certainty whether a user of the Grid Singularity event website de facto represents the person/company that the user/the company purports to be. Grid Singularity therefore shall not assume any liability whatsoever for the actual identity of a user. Each and every user is solely responsible for personally verifying the authenticity of other users.
    19. The user commissions Grid Singularity to present his/her/its data (profile, see Data Privacy Protection) as a profile within the framework of the different types of account(s) and functions of the event website and other event publications and to convey the data to other registered users and companies that participate in the event website. Thereby, depending on user input or participation in an event, references will be appended to the profile (for example, but not limited to,  professional affiliation). Further, apposite registered users and both registered and non registered companies (investors, start-ups) will be ascertained by Grid Singularity within the framework of the Grid Singularity matchmaking process and profile data for the purpose of establishing contacts will be transferred.
    20.  Grid Singularity is not liable for external links and content entered by users on the event website.
    21.  User(s) promise and guarantee not to post falsehoods, racist, discriminatory, inflammatory or other harmful content.
    22. From the data either entered or uploaded (for example, but not limited to, pictures, logos, etc.) the user transfers Grid Singularity the spatio-temporal unlimited licensing rights (e.g. for print, web, etc.).
    23. The user agrees that within the context of his/her/its contract (registration), data (including, but not limited to, information such as surname, first name, date of birth, year of company founding, company name, address, email address, websites, country of origin, if applicable: industry, technology, Twitter ID, LinkedIn ID, Facebook ID, profile picture, etc.) and any other data provided, as well as retrievable public data required by Grid Singularity to fulfil the contract, will be further processed for the following purposes:
      1. Market research for internal purposes
      2. Advertising
      3. Sending information (on/offline, e.g. per email/post)
      4. Anonymous statistics
      5. Compilation of publications by Grid Singularity
      6. Automated creation of public online profiles (whereby the Grid Singularity event website provides features and/or functions whereby the user can regulate which data should be displayed
      7. On- and offline matchmaking — including, but not limited to — (between participants and attendees, participants and companies, business and enterprise), based on data entered by the user
      8. Incorporation of personalized third-party overlays superimposed on Grid Singularity pages, (including, but not limited to, Facebook, Twitter, etc.)
    24. Further, the user agrees that publicly retrievable data (e.g. telephone book, etc.) will be collected and merged with data accumulated within the framework of the contract and processed by Grid Singularity for the aforementioned purposes. This consent may be revoked at any time per letter or email to Grid Singularity.
    25. The user agrees to receive and/or accept both written and electronic (email, Twitter messages or other) newsletters and other information from Grid Singularity.
    26. Within the framework of Grid Singularity events (Event Horizon, etc.), audio, picture and video recordings of the individual participants and the event will be created free of charge. The participants in these events agree that the recordings and images/photographs submitted by participants, and the unlimited spatio-temporal use can be used free of charge for press reports, advertising posters, calendars, brochures, commercial products and manuals, and on Grid Singularity websites and third party websites (e.g. right of use for YouTube, Vimeo, Facebook, etc.) and these rights of use may be given to third parties by Grid Singularity, both free of charge and also against payment. If the participant does not want his/her photograph to be taken and/or does not want to be filmed, Grid Singularity must be notified in writing, by email, prior to the Event.
    27. Service provider: Grid Singularity will provide its data processing using service providers according to §10ff of the German Data Protection Law. The customer expressly agrees to the relinquishment and usage of the data collected from users. (including to service providers based outside of the EEA (European Economic Area) for the purpose of data processing for Grid Singularity and respectively, or as the case may be, to service providers with Safe Harbor Certification (see http://safeharbor.export.gov/list.aspx). This consent may be revoked per letter or email to Grid Singularity. The following service providers outside the EEA participating in the Safe Harbor Certification may be used:

    28. Unless otherwise stated, all prices shown on the Grid Singularity event website exclude value added tax (VAT).
    29. Consumers should note that that there is no right of withdrawal as defined in §312g of the German Civil Code (BGB) since the provision of services within the scope of recreational activities (§312g, para.2 No. 9, German Civil Code (BGB)), which also includes events, is excluded from the right of withdrawal.
    30. Court of Jurisdiction is the relevant court in 1010 Vienna. Contractual relationships with Grid Singularity are subject exclusively to Austrian law, excluding the CISG (United Nations Convention on Contracts for the International Sale of Goods).
